Title: Sexual Assault and Other Acts of Sexual Misconduct

1. It is a policy of the District Board of Trustees of Palm Beach State College that the criminal act or attempted act of sexual assault/battery (rape) and other forms of sexual misconduct shall not be condoned or tolerated. The College shall take a proactive stance in the prevention of such misconduct at its campuses and functions. The College shall refer all cases of sexual assault or attempted sexual assault occurring on College property or at College functions to law enforcement authorities for investigation, prosecution and any other actions these authorities may decide to be proper.

2. The president or designee shall establish procedures that include, but are not limited to, the protocol for dealing with these acts, disciplinary procedures for students and employees, victims’ rights, services for victims, confidentiality, and educational and other preventative programs. For the purpose of establishing these procedures, the following definitions shall be used:

  • Sexual Assault is legally defined in Florida Statute 794.011 Section (1).
  • Sexual Misconduct includes, in addition to sexual assault, sexual harassment, public indecency and voyeurism.
  • Sexual Harassment is the imposition of unwelcome sexual advances, favors, or verbal or physical conduct of a sexual nature upon an individual including the creation of a hostile environment which prevents or impairs that individual’s full enjoyment of educational benefits, climate or opportunities.
  • Public Indecency is the act of expressing one’s body in such a manner that another person can reasonably be offended, or sexual conduct where another can be reasonably offended.
  • Voyeurism is the act of trespassing, spying or eavesdropping for purposes of sexual arousal.
